This page is intended to give you practical information about how the PainChek App uses your personal information if you are a patient or a resident in a facility that uses the PainChek App for your care.

However, the facility remains responsible for your personal information. You should always contact the facility to obtain more details of how it uses your personal information or to exercise your personal information rights.

1. What does the PainChek App do?

The PainChek app is designed to assist your care facility in your clinical management and care. It does this by:

  • completing an assessment of your pain (this is called a “pain assessment”);

  • recording the pain assessments in your digital record;

  • providing an analysis of your pain assessments; and

  • allowing your carers to record the pain relief or interventions that have provided to you.

2.  What personal information does the PainChek App use?

To assist in your clinical management and care, the PainChek App stores and uses the following personal information:

Resident Profile

To support the management of your care, a Resident Profile is created for you by the facility. This Resident Profile is used to associate pain assessments, pain assessment records and interventions with you. These assessments and interventions are recorded in your Resident Record.

  • your photograph;

  • your first name, last name, and nickname;

  • your gender;

  • your date of birth; and

  • details of which facility you are in.

Pain Assessments

The PainChek App’s purpose is to help complete pain assessments. There are three types of pain assessment: (i) Video Assessments, using technology to assess your pain from an analysis of your face; (ii) Manual Assessments, where your carer assesses your pain; and (iii) Self-reporting Assessments where you tell the carer about your pain.

  • details of the assessment completed, including details of how the assessment has been reached by reference to pain markers or indicators, and any physical symptoms;

  • recordings of your voice if you or the carer want to use this to help understand your pain experience;

It is important to note that although Video Assessments involve an analysis of your face, the PainChek App does not capture or record video images.

Resident Record

The PainChek App allows your carer to maintain a record of your pain assessments and care so it can be used to support your clinical management and care.

  • a record of each pain assessment completed and saved against the your record;

  • your pain chart;

  • the pain relief and therapies administered to your; and

  • comments concerning your pain experience or care recorded by your carer

 3. Who is responsible for my personal information?

The facility in which you are resident is at all times responsible for your personal information. The personal information collected and stored on the PainChek App is under the control of the facility and nobody else. It is not transferred or otherwise disclosed to PainChek.

4. On what basis can the facility use my personal information in this way?

The facility has responsibilities for your clinical management and care. These are legal, ethical, professional and contractual. The facility has decided that it is in your best interests that your clinical management and care is supported through the use of technology like the PainChek App and when making that decision they also identify the legal basis on which your personal information can be used. More information can be obtained from the facility.

 

5. How long is your personal information kept?

This is decided by the facility. The facility can delete your personal information from the PainChek App and, once it is deleted, it is no longer available.

6. How is my personal information kept secure?

PainChek has designed the PainChek App to ensure your personal information is kept confidential and secure. PainChek has also adopted an Information Security Management System meeting international standards as well as standards required by health agencies in the countries in which the PainChek App is available.

 7. What are my rights?

You have various rights in respect of the facility’s use of your personal information. These rights must be exercised by contacting the facility directly, PainChek cannot process these requests on the facilities behalf.
